Intel can pay the $2 Billion out of cash if necessary. Intel has plenty.
I still don't understand where you get the bankruptcy idea from. The best I can tell is that Intel will make more money in 2007 than it did in 2006. Also, I would expect AMD to take no more than 2.5% share during 2007. Intel should be doing fine by Q2 08.
BTW, AMD won't have significant volumes of K10 until at least Q2 08 so where would the financial pressure for Intel come from? AMD does get a small boost by mid 2008 with FAB 38 online and reduced costs because of two 300mm FABs. However, Intel will be at 45nm first so it will have the benefit of reduced process cost first. Also, Intel has the new socket and IMC to look forward to in 2009. I'm seeing no evidence of bankruptcy even by 2010. In fact, we aren't even sure that AMD will build the NY FAB and it can't take much more share without it.

So if Intel looses would it mean it'll BK even sooner?
It's $2.2 Billions + Interest for 1999 to 2005 and $200 million plus interest for 2006.
Total : $2.6 Billions or one 45nm Fab.
